The present General Terms and Conditions are applicable in case of purchasing from the webpage run by WIRTUM Bt.
Information connected to WIRTUM Bt. is available under the menu ’Impressum’.
By purchasing from the webpage, the Customer accepts the General Terms and Conditions and acknowledges them as obligatory.
The webpage is available in Hungarian and English, orders are accepted in Hungarian or English.
1.1. Anyone can register on the webpage free of charge.
1.2. Shopping can happen only after registration and signing in (Menus: Registration, Signing in).
1.3. WIRTUM Bt. sends an automatic confirmation e-mail to the given e-mail address after successful registration.
1.4. Deleting an account can be requested in e-mail sent to firstname.lastname@example.org.
2. Process of placing an order and shopping
2.1. Selecting the product
The available products can be found in the Home Page/Shopping menu.
If a product is out of stock and cannot be purchased in the given time period, it cannot be put into the Shopping Cart. This is indicated by the pale green colour of the Shopping Cart. If a product is available and is in stock, the Shopping Cart is green.
By clicking on the picture of a product, the information related to the product can be viewed. If the product is out of stock, there is a warning „This product is out of stock” on the product page containing the product information. If the product is in stock, the price of the product and the Shopping Cart is displayed.
After choosing the amount and the colour, the product can be selected by clicking on the „Cart” button.
2.2. Shopping Cart (Summary)
After selecting the product, the content of the Shopping Cart can be viewed.
Here the amount of the product can be modified, or the selected product can be deleted.
If the Customer has a discount coupon, the number of that coupon can be given on the Shopping Cart (Summary) page or the Payment page by writing it into the “Coupons” box.
Several products can be ordered during one shopping process by clicking on the “Continue shopping” button.
2.3. Signing in
Shopping continues with clicking on the “Proceed to checkout” button.
If the Customer has not signed in the webpage, in the next stage they can register or sign in if they have a registered account (by giving the user name and password).
The Customer gives the shipping address. If the shipping and billing address is not the same, than a new billing address should be given.
The Customer has the opportunity to add comments to shipping.
The Customer selects the method of shipping. (WIRTUM Bt. informs the Customer that we currently have a contractual relationship with the DPD courier service only, thus products are delivered only by DPD.)
The page contains the time of shipping and the name of the delivery company as well.
The content of the Shopping Cart appears, which the Customer can check.
The Customer can choose from the following Payment methods:
A) Electronic bank transfer
B) Payment through the system of B-payment
In the next step, the Customer verifies the order.
After placing the order, WIRTUM Bt. sends a confirmation e-mail to the given e-mail address in connection with the products ordered.
If confirmation does not arrive within 48 hours from placing the order, the Customer is not subject to offer validity or contractual obligations.
WIRTUM Bt. starts the shipping process only if the given amount arrives to the bank account of WIRTUM Bt. specified in the confirmation e-mail.
After successful payment, WIRTUM Bt. sends a confirmation e-mail to the Customer, which informs the Customer about successful payment.
Every order has its unique identification number.
The bill about the order is sent within the package.
Until payment, the Customer (in any stage of the shopping process) can correct data input mistakes (e.g. wrong amount, wrong shipping address). If the Customer notices a mistake within the order after payment, they are obliged to notify WIRTUM Bt. within one day.
3. Prices and costs displayed on the webpage
3.1. All prices include VAT.
Product prices include shipping and packaging costs as well.
3.2. Payment can be made in HUF or EUR, depending on the choice of the Customer.
The exchange rate between EUR and HUF is determined by WIRTUM Bt. The currently applied exchange rate is: 1 HUF=0.003217 EUR.
4.1. The product cannot be taken over personally, shipping is only carried out by the courier service.
4.2. We ship to the following countries:
4.3. WIRTUM Bt. delivers the product within a maximum of 30 days following successful payment.
WIRTUM Bt. informs the Customer that the average shipping time is generally 3-8 workdays from the day of payment.
(The day of payment is the day when the price of the product arrives on the bank account of WIRTUM Bt.)
4.4. If the first delivery attempt is unsuccessful, the courier service leaves a written notice for the Customer. On the next workday the courier service attempts to deliver the package again. If this is also unsuccessful, the courier service leaves another written notice for the Customer, and the Customer has the opportunity to agree on a third date (final deadline) via phone within seven days, when the product can be delivered.
5.1. Customers may only use the product ordered via our webpage at their own risk. WIRTUM Bt. is not responsible for damages arising from the use of the product (except for responsibility for breach of contract damaging or harming human life, physical security or health, or intentionally caused damages).
5.2. WIRTUM Bt. declares that the products do not qualify as therapeutic equipment, or as medicinal products not qualifying as medicine; the products are not suitable for medical purposes.
6.1. Textual, graphical or photographic content etc. of the website are subject to copyright. Use of the content of the webpage is only possible by obtaining a written permission from WIRTUM Bt.
7. Information on withdrawal from the contract based on Government Decree 45/2014
7.1. Right of withdrawal from the contract
The Customer has the right to withdraw from the contract within 14 days without explanations.
The deadline for withdrawal expires 14 days after the day the Customer or an authorized person took over the product.
If the Customer wants to assert their right of withdrawal, they have to forward their unequivocal statement of withdrawal to one of the following addresses: Wirtum Bt., 3 Jászapáti Street, Budapest 1172, or email@example.com. The Customer can use the withdrawal statement sample of Appendix 2 of Government Decree 45/2014.
The Customer asserts their right of withdrawal in time if they forward their statement of withdrawal before the above-mentioned deadline.
7.2. Legal effects of withdrawal
If the Customer withdraws from the contract, WIRTUM Bt. forthwith - or within a maximum of 14 days following the receipt of the statement of withdrawal - refunds all products and services, including shipping costs. WIRTUM Bt. refunds the money using the same method of payment the Customer has paid with, except if the Customer requests another method of payment; requesting another method of payment does not cost additional charges for the Customer.
The Customer is obliged to return the product without unjustified delay, but 14 days at the latest following the statement of withdrawal. If the Customer sends back the product before the 14-day long deadline expires, it qualifies as meeting the deadline.
The Customer bears the costs of returning.
The Customer is only responsible for depreciation of the product if depreciation resulted from overuse of the product beyond the necessary use for establishing the nature, the characteristics and the operation of the product.
8. Information on mandatory warranty, manufacturer’s warranty and guarantee based on the Government Decree 45/2014
8.1. Mandatory warranty
In what cases can the Customer assert their right to mandatory warranty?
If WIRTUM Bt. fails to meet their contractual obligations and provides a defective performance, the Customer can assert their right to mandatory warranty according to the regulations of the Civil Code (Act V of 2013).
What rights does the Customer have based on their claim for mandatory warranty?
The Customer can choose from the following claims for mandatory warranty:
The Customer can ask for repair or replacement, except if the chosen claim is impossible to perform or it would cost additional charges for Wirtum Bt. than performing another type of claim. If the Customer did not or could not ask for repair or replacement, the Customer may ask for an appropriate reduction of the price, or the Customer can repair the product himself or can have the repair done at the expense of the company, or in the final case, the Customer can withdraw from the contract.
The Customer can switch to another claim from the originally chosen one, but the cost of the switch should be on the Customer, except if the switch was justified or the company gave rise to it.
What is the deadline for the Customer to assert their claim for mandatory warranty?
The Customer is obliged to announce the defect without delay following its exploration, but within a maximum of two months.
The Customer’s claim for mandatory warranty expires a year after the date of performance. If the Customer is the Consumer as well, their claim for mandatory warranty expires two years after the date of performance.
Who is responsible for fulfilling a claim for mandatory warranty?
The company (WIRTUM Bt.) is responsible for fulfilling claims for mandatory warranty.
Are there any other conditions for asserting the right of mandatory warranty?
There are no other conditions for asserting the claim for mandatory warranty in the first six months following the performance besides announcing the defect, if the Customer proves that the product was provided by WIRTUM Bt. After the expiration of the six months following the performance, the Customer has to prove that the defect has been already present at the time of performance.
8.2. Manufacturer’s warranty
In what cases can the Customer assert their right to manufacturer’s warranty?
In case of the defect of moveable goods (products) the Customer (depending on their choice) can assert their right to mandatory warranty (outlined in 8.1.) or manufacturer’s warranty.
What rights does the Customer have based on their claim for manufacturer’s warranty?
As a claim for manufacturer’s warranty, the Customer can only ask for the repair or replacement of the defective product.
In what cases does a product qualify as “defective”?
A product is defective if it does not meet the quality requirements effective at its release, or if it does not have the characteristics outlined in the description given by the manufacturer.
What is the deadline for the Customer to assert their claim for manufacturer’s warranty?
The Customer can assert their claim for manufacturer’s warranty within two years of the release of the product. By the expiration of this deadline the Customer loses this right.
Who is responsible for fulfilling a claim for manufacturer’s warranty? Are there any other conditions for asserting the right of manufacturer’s warranty?
The Customer can assert their claim for manufacturer’s warranty against the manufacturer or retailer of the product. In case of a claim for manufacturer’s warranty, the Customer has to prove the defect of the product.
In what cases is the manufacturer (retailer) exempt from their obligation of providing manufacturer’s warranty?
The manufacturer (retailer) is only exempt from their obligation of providing manufacturer’s warranty, if they can prove that:
- The product was not produced or released in its scope of business activities, or
- The defect was not recognizable at the time of release according to the then-current state of science or technology, or
- The defect of the product resulted from conforming to laws or obligatory regulations of authorities.
From the part of the manufacturer (retailer), it is sufficient to prove one reason to become exempted.
A claim for mandatory warranty and a claim for manufacturer’s warranty cannot be asserted at the same time because of the same defect. However, following the successful fulfilment of a claim for manufacturer’s warranty, the replaced or repaired product can still be the object of a claim for mandatory warranty against the manufacturer.
In case of defective performance, WIRTUM Bt. is obligated to provide guarantee according to the Government Decree 151/2003 about obligatory guarantee on consumer durables.
The duration of guarantee is one year. The duration starts on the day of the delivery of the product.
What rights does the Customer have based on the guarantee?
In case of a defect included in the guarantee, the Customer:
- Can ask for repair or replacement, except if the chosen right to mandatory warranty is impossible to fulfil, or it would cost additional charges for Wirtum Bt. than performing another type of claim, considering the value of the service in its flawless state, the weight of the breach of the contract, and the harm of interests caused for the claimant by the fulfilment of the right to mandatory warranty.
- Can ask for an appropriate reduction of the price, or the Customer can repair the product himself or can have the repair done at the expense of the company, or can withdraw from the contract, if the obligant could not repair or replace the product, or could not meet their obligation preserving the interests of the Customer, or if the interest of the Customer for repair or replacement ceased.
An insignificant defect cannot constitute a cause for withdrawal from the contract.
In what cases is the company exempt from their obligation of providing guarantee?
The company only becomes exempt from their obligation to provide guarantee if they prove that the cause of the defect arose after the performance.
A claim for mandatory warranty and a claim for guarantee, or a claim for manufacturer’s warranty and a claim for guarantee cannot be asserted at the same time because of the same defect; however, the Customer is qualified for the right to guarantee independently of the rights outlined in 8.1. and 8.2.
9. Asserting consumer rights
The Consumer can file their complaint at the registered office of the company (3 Jászapáti Street, Budapest 1172), or via phone (phone number: +36 1 633-3674), or via e-mail (e-mail address: firstname.lastname@example.org) or in writing (address: 3 Jászapáti Street, Budapest 1172).
WIRTUM Bt. examines verbal complaints forthwith, and offers solutions accordingly. If the Consumer does not accept the management of the complaint, or the immediate examination of the complaint is impossible, Wirtum Bt. registers the complaint and their related point of view forthwith, and a copy of the registered complaint
a) is given on the spot to the Consumer in case of verbal complaint filed personally,
b) is at the latest sent together with the reasonable answer in case of verbal complaint filed via phone or using other types of electronic telecommunications service.
Written complaints are examined within 30 days following the receipt of the letter of complaint, and a written answer is sent to the Consumer. In case of a rejection of a complaint, WIRTUM Bt. offers its reasons.
9.2. Arbitration Board
